Law of succession

Inheritance law sets out the rules for distributing the inheritance among the various heirs (children, surviving spouse, parents, brothers and sisters, etc.). This distribution is based on mandatory rules, such as the existence of an inheritance reserve in French law for the benefit of children and the surviving spouse in certain defined cases. However, on the wishes of the deceased, gifts may be made, during his or her lifetime or on deathbed but within the limit of the available portion.

The law of succession, also deals with the liquidation and division of the estate, which in some cases must be preceded by the liquidation of the matrimonial property.

It is becoming increasingly common for people to pass away abroad, or to leave property when they decease, in a country other than their country of nationality or residence.

Depending on whether you are a reserved heir, surviving spouse, legatee by particular title or by universal title, or the beneficiary of a life insurance policy, we can inform you of the options available to you and the rights you have in the estate.

We can assist you throughout the process of settling the estate: when drawing up the declaration of inheritance, the deed of notoriety, the deed of partition or when meeting with the notary in charge of the estate. Pending settlement of the estate, we can advise you on how to manage the joint ownership of the estate.

Negotiations and amicable division are encouraged. If this fails, we can represent you in a judicial division to put an end to the indecision of inheritance between the co-heirs or to appoint an estate agent.
